A Tax Calculator for You to Try as Washington Debates - NYTimes ...

If you?re like me, you have been following the debate over the so-called fiscal cliff with a sort of low-grade headache. With so many variables, it?s hard to keep all the possible outcomes straight.

The Tax Policy Center, a joint venture of the Urban Institute and the Brookings Institution, has taken a crack at helping individual taxpayers evaluate how various options would affect their overall federal tax burden, including both payroll taxes and income taxes, next year. The center has created a set of calculators that allows you to compare the total tax liability for different sorts of taxpayers in 2013, based on four scenarios. (Wonk warning: The calculator was created by tax policy mavens, so it contains a great deal of detail, perhaps a bit too much for a casual user.)

Still, if you ?re interested in what might result, or not, from the negotiations in Washington, here are the four tax policy scenarios presented in the tool. The calculator doesn?t reflect the latest proposal made by House Republicans because it lacked sufficient detail about tax rates to model, said Roberton Williams, senior fellow at the Tax Policy Center:

1) 2012 tax law (with an alternative-minimum-tax patch, to limit the number of taxpayers affected by the tax). This is what you?d pay if Congress continued the tax policy in place this year, with an A.M.T. patch, for 2013 income.

2) 2013 tax law. This is what you would pay for all of next year if Congress doesn?t act.

3) The Senate Democratic plan, which would extend the expiring Bush-era income tax cuts for a year for all except the top 2 percent of taxpayers. It would extend the credits originally enacted by President Obama in 2009, but allow the temporary payroll tax cut to expire.

4) The Senate Republican plan, which would extend the Bush-era income tax cuts for everyone but would allow the 2009 credits and the temporary payroll tax cut to expire.

The site offers examples for six basic taxpayer scenarios (single with no children, married with two children under 13, etc.) that you can further tweak with your own information.

Among the various assumptions built into the calculator is that both the employer and employee shares of the payroll tax ? the taxes that fund Social Security and Medicare ? are assigned to the worker. A note explains, ?Economists believe that the employer?s share of the tax is actually borne by the worker in the form of lower wages and therefore the tax calculator assigns both employer and employee shares of the tax to the worker.?

To look at just one example, the calculator shows that a single filer with no children and adjusted gross income of $18,600 would have a total tax liability (including payroll and income taxes) that is $802 higher under the 2013 scenario if Congress fails to act, than under the scenario of continuing the 2012 tax laws with an A.M.T. patch.

The total liability for the same taxpayer, under either the Senate Republican plan or the Senate Democratic plan, would be $372 higher than the patched 2012 scenario, according to the calculator.

Put another way, the taxpayer?s liability would be $430 higher under the 2013 scenario of Congress failing to act, than under either of the Senate plans.

Gigantic Health Insurance Companies Might Not Be So Bad, After All ...

Among other things, Austin Frakt has taught me to view the healthcare market as a competition between providers and insurance companies. If you have a market served by lots of hospitals and only one or two insurance carriers, then the insurance companies have a lot of leverage: they each represent a huge chunk of the customer base and can threaten to take their business elsewhere if a hospital charges too much. In the opposite situation, with only one or two hospitals in a region, they're the ones with the leverage. Even if their prices are high, insurance companies can't withdraw their business because there are no other choices available.

What this means is that "more competition" doesn't necessarily lead to lower prices. Over at Economix, a trio of researchers confirms this using a state-by-state comparison:

We examined the relationship between insurer market power (defined as the market share of the two largest companies) and changes in premiums. We found that concentration of insurer power ? hence less competition ??was not significantly associated with higher premiums, as can be seen in the chart below.

In English, this means that a small number of big insurance carriers generally led to lower premiums:

Hawaii is a good example. Kaiser Permanente and Blue Cross Blue Shield together controlled more than 90 percent of the insurance market in 2001. In this highly concentrated market, the average premium rose only 72 percent over the decade, compared to an overall increase of 135 percent nationwide. By contrast, Virginia had one of the most competitive markets in 2001, with its two largest insurers controlling only 25 percent of the market, yet premiums in the state increased nearly 140 percent over the period.

I've never been persuaded that insurance companies provide any real benefit in the healthcare market, since what they offer is only barely "insurance" in the usual sense. Mostly they're just intermediaries, with their market power to drive down prices slightly outweighed by their high administrative costs. Net effect: pretty close to zero. It's providers and consumers who really drive prices, not the middlemen. Still, this study suggests that as long as we're stuck with private insurance companies, we're probably better off with a few big, powerful ones. Competition between insurers is just another way of giving providers more leverage, and they're the ones who really control prices.

Harvard recognizes group promoting safe kinky sex

(AP) ? Kinky sex has been admitted to Harvard.

The nation's oldest university has formally recognized Harvard College Munch, a group promoting discussions and safe practices of kinky and alternative sex. The school has no record of a similar group being recognized in its 376-year history.

The Committee on Student Life recognized Munch on Friday, making it one of 400 independent student organizations on campus. The decision occurred more than a year after members began meeting informally over meals.

"Applications for recognition are decided by a student-faculty committee following the review of a committee composed of students and administrators," Harvard spokesman Jeff Neal said in a statement Tuesday. "The college does not endorse the views or activities of any independent student organization."

Harvard is not the first school in the country to formally recognize kinky sex groups, and several active groups exist within the larger community in Cambridge and neighboring Boston.

Organizers of Harvard College Munch did not immediately respond to an email seeking comment on Tuesday.

In a statement posted on a Harvard website, organizers say the group is for students interested in kink and alternative sexualities to meet and organize relevant events including speakers, discussions and screenings. Munch also has created a safety team to enable victims of abuse or trauma get help.

"It exists to promote a positive and accurate understanding of alternative sexualities and kink on campus, as well as to create a space where college-age adults may reach out to their peers and feel accepted in their own sexuality," the statement said.

"Though existing campus groups range from representing women and men, queer sexualities and orientations, all the way to groups dedicated to abstinence, no other group exists as a forum for students interested in alternative sexualities to explore their identities and develop a community with their peers," organizers said.

The group started with seven people and now has about 30 members. The statement didn't identify any of the members.

The Harvard Crimson school newspaper quotes one founder, identified only as Michael, as saying that recognition "comes with the fact of legitimacy" and shows members are being taken seriously. There are also practical benefits to formal recognition, including the ability to apply for grants, post notices and secure convenient time and locations for meetings, the founder said.

The Crimson reported that the group's efforts to gain official recognition last spring were foiled by trouble finding an adviser and problems with its constitution.

San Francisco's most expensive piece of residential real estate is in contract. That's right, folks. 2901 Broadway on Billionaire's Row has found someone willing to plop down eight figures for the 8-bed, 7.5-bath Italian Renaissance hilltop mansion.

In late August we got word that the big abode's owners were in talks with several firms about a complete renovation to the property. You see, while the $34,000,000 mansion has been on and off the market without a single offer since 2006 (when it landed on the market it was asking $58M), there are now several interested parties, including one young and very wealthy tech family. Let the guessing games begin about who the home's next owner(s) might be.

As you may already know, the property's in dire condition. Its facade was also a victim to graffiti last year. The home's got a decrepit outdoor tennis court (that's rumored to get a makeover as a lavish outdoor oasis) and a "Curio Room" that used to house the original owner's "extensive oological collection." If this home sells before 2013, it will easily be the most expensive sale of the year. We're hoping for another late in the year blockbuster sale, just like the St. Regis penthouse did last year when it sold for $28,000,000 on December 16.

Carbon dioxide emission reductions required to limit global warming to 2?C are becoming a receding goal based on new figures reported today in the latest Global Carbon Project (GCP) calculations published today in the advanced online edition of Nature Climate Change. "A shift to a 2?C pathway requires an immediate, large, and sustained global mitigation effort" says GCP executive-director and CSIRO co-author of the paper, Dr Pep Canadell.

Global CO2 emissions have increased by 58% since 1990, rising 3% in 2011, and 2.6% in 2012. The most recent figure is estimated from a 3.3% growth in global gross domestic product and a 0.7% improvement in the carbon intensity of the economy.

Dr Canadell said the latest carbon dioxide emissions continue to track at the high end of a range of emission scenarios, expanding the gap between current trends and the course of mitigation needed to keep global warming below 2?C.

He said on-going international climate negotiations need to recognise and act upon the growing gap between the current pathway of global greenhouse emissions and the likely chance of holding the increase in global average temperature below 2?C above pre-industrial levels.

The research, led by Dr Glen Peters from CICERO, Norway, compared recent carbon dioxide emissions from fossil fuel combustion, cement production, and gas flaring with emission scenarios used to project climate change by the Intergovernmental Panel on Climate Change (IPCC).

"We need a sustained global CO2 mitigation rate of at least 3% if global emissions are to peak before 2020 and follow an emission pathway that can keep the temperature increase below 2?C", Dr Peters said.

"Mitigation requires energy transition led by the largest emitters of China, the US, the European Union and India".

He said that remaining below a 2?C rise above pre-industrial levels will require a commitment to technological, social and political innovations and an increasing need to rely on net negative emissions in future.

Canton-based nonprofit joins revitalization effort in Haiti | Canton ...

When Canton resident Bruce Beckham gave up his marketing and consulting business 12 years ago to take over as executive director of a fledgling nonprofit aimed at preserving tourist sites, he didn?t expect to become a man of influence or an industry standard bearer.

He certainly didn?t envision a time when he would be rubbing shoulders with Hollywood A-listers or world leaders. Yet there he was, late last month, flying on a private jet to Haiti to tour a brand-new industrial park with a star-studded contingent led by former President Bill Clinton and his wife, Secretary of State Hillary Clinton.

The event, dubbed ?A New Day in Haiti,? marked the grand opening of the 600-acre Caracol Industrial Park, a venture financed by the U.S. government and the Inter-American Development Bank (IDB) in partnership with Korean clothing manufacturer Sae-A Trading Co.

Notable guests at the day-long celebration included President of Haiti Michel Martelly and former president Rene Preval, IBD President Luis Alberto Moreno, Virgin Atlantic founder and British billionaire Richard Branson, actors-activists Sean Penn and Ben Stiller, and fashion designer Donna Karan, along with various State Department officials and world business leaders.

Some of the attendees, like Branson and Karan, are looking to develop business relationships in Haiti; others, including Penn, have been active in relief efforts in the aftermath of the devastating January 2010 earthquake that killed more than 300,000 people.

In Beckham?s case, he was tapped by the Clinton Foundation in hopes that the organization he oversees, Tourism Cares, might be able to work with the Haiti government to help the country rediscover its potential as a tourist destination.

As Beckham explained in an interview with Travel Weekly, ?Tourism Cares was there because board members Brad Finkle of TripMate, Don Hawkins of George Washington University, and Robin Tauck of Tauck World Discovery ? set the stage for our participation. It is a tribute to Tourism Cares? work and the Clinton Foundation?s belief that we can be a part of Haiti?s restoration and renaissance.?

Until recently, Tourism Cares has focused most of its energy on three major initiatives: awarding grants to cultural and historic sites around the world; supporting the future tourism workforce through scholarships, internships and mentoring programs; and bringing members of the current workforce together for cleanup and restoration projects as well as other volunteer opportunities.

The bulk of the group?s work has taken place at sites throughout the United States; however, just last May it launched a new Global Outreach Initiative that would appear to be a perfect fit for a potential partnership in Haiti.

?What we?re offering in this unique situation is to work with the Haiti Tourism Association and with their minister of tourism to bring to them the knowledge that we have in our stable,? said Beckham, ?and we can gather those [industry experts] and go down there in the same way as any other missionary would.?

Beckham said the grants that Tourism Cares could offer would be small in comparison to what is needed, but what they can provide is expertise in a variety of areas ? from service standards to marketing and knowledge of best practices.

He noted that the island nation was traditionally a great destination for tourists ? the Clintons spent their honeymoon there ? but it has been ravaged by poverty, violence, and natural disasters.

?Haiti has a lot to offer,? said Beckham. ?It?s obviously had its political upheavals, and it?s created its own misery in a lot of cases, but it has great food, great beaches, great history, arts and culture, so there?s great potential there for a rebirth in the tourism industry.?

And while it will likely take years or even decades for Haiti to realize its full potential, Beckham came away from the visit excited and hopeful about his chance to contribute.

He credited the Clinton Foundation, and President Clinton in particular, with ?getting the right people together? and using his connections to spur action and bring about change.

?The Clinton Foundation doesn?t have a ton of money,? he said, ?but President Clinton certainly has a lot of influence. He?s a very charismatic individual who is very passionate about giving back and making the world a better place.?

Through a partnership with the foundation, Beckham envisions a program in Haiti similar to the one that Tourism Cares recently launched in Cusco, Peru. There the organization teamed up with the Peruvian tourism industry and some of the tourism students to share knowledge and ideas while also completing a service project at the San Pedro marketplace.

Beckham said they helped to make the massive indoor marketplace more appealing to tourists by painting over graffiti, planting flowers, and adding signage. ?We made a huge difference in a day,? he said.

Beckham said there are numerous sites in Haiti that could be similarly transformed ? places such as the Citadel, a magnificent mountaintop fortress that ?nobody goes to? because there are no roads that lead to the site.

?This is not something that?s going to happen overnight,? he said, ?but there are thousands of cruise passengers and tourists that would be interested in sites like this one. That?s what?s going to create commerce there, and commerce puts food on kids? tables. Tourism is a tremendous way to build an economy.?

Big-box retailers are tired of being the showroom floor for people who visit the store to see how a product looks, but then head home to buy it cheaper online.

That?s why this holiday season they're stepping up their game, both in store and online.?

Retailers such as Target, Wal-Mart and Sears have added features aimed to make coming into the store more enticing, such as better deals for layaway and more aggressive price matching.

Some brick-and-mortar stores also are trying to get people who buy online to at least do it from their company, and perhaps even while they are in the store. Target has started offering a service where people can scan a code with their cell phone, buy the item and have it shipped anywhere, for free.?

Relief ruling fires up McIlroy at Ryder Cup

MEDINAH, Ill. (AP) ? An unfavorable ruling turned out to be the jumpstart the Europeans needed.

Fired up when they were refused relief on the second hole, Rory McIlroy and Graeme McDowell have gone on a birdie run and are setting the tone for Europe's early dominance at the Ryder Cup on Friday.

It was exactly the kind of start European captain Jose Maria Olazabal hoped for when he sent his strongest pair off first in the foursomes.

McIlroy and McDowell closed the front nine with birdies on five of the last six holes, and were 3 up on Jim Furyk and rookie Brandt Snedeker through 12 holes. Ian Poulter and Justin Rose were taking advantage of the shaky start by Tiger Woods and Steve Stricker, who were lucky to only be 1 down at the turn.

Fourballs will be played Friday afternoon. Europe has won four of the last five Ryder Cups.

McIlroy's tee shot on the par-3 No. 2 landed a few inches in front of the sprinkler head, and McDowell asked for relief. The Americans seemed to indicate it wasn't needed, and two referees agreed, forcing McDowell to chip. The Europeans wound up bogeying the hole, giving the U.S. its first lead of the day.

But two holes later, McIlroy chipped in from behind the green to square the alternate-shot match. The world No. 1 screamed and threw a roundhouse punch when the ball went in the cup, and slapped McDowell's hand so hard his friend will likely be feeling it the rest of the day. That started a run of four straight birdies, with the Northern Irish duo making one big shot after another.

They even got some help from the Americans. Furyk called a penalty on himself when the ball moved ever so slightly as he took a practice swing on the 10th hole. He and Snedeker wound up with a bogey, and a bogey on the next hole gave the Europeans their biggest lead in any of the matches.

Stricker and Woods are 6-2-0 together in match play, and U.S. captain Davis Love III asked them to anchor the morning session. But they were in trouble right from the start, with Woods pushing his drive on No. 1 so far left it came to a rest against a fence in the corporate hospitality area. Stricker made a nice recovery and the Americans salvaged a halve against Ian Poulter and Justin Rose.

But they fell behind on the next hole, when Stricker put his tee shot in the water. Woods sprayed another tee shot into the gallery on No. 5, missed a short par putt on No. 6 and chunked a flop shot on the par-3 No. 8. But Rose missed ? badly ? on his par putt to win the hole as the Americans finally caught a break.

If we look back and analyse the recent developments in the field of mobile devices, we would observe that the rate of iOS and Android device adoption has surpassed that of any consumer technology in history. If this rate is compared to recent technologies, it is interestingly observed that smart device adoption is being adopted 10 times faster than that of the 80s PC revolution. In a span of almost five years, expansion of this new technology is rapidly expanding beyond early adopter markets such as such as North America and Western Europe. Mobile apps are similar to other software and business methods when it comes to patent eligibility and patentability, which effectively implies that apps are patentable.

For example, Google has been recently awarded a patent, called ?Login to a computing device based on facial recognition,? that describes a technology for identifying a person?s face and delivering to that person full access to personal information on a device. In use, Google?s patent requires a camera that can identify a person?s face. If that face matches a ?predetermined identity,? then the person is logged into the respective device. If multiple people want to access a computer, the next person would get in front of the camera, and the device?s software would automatically transition to the new user?s profile.

To satisfy the patentability and patent eligibility in US, an invention must meet the requirements of 35 U.S.C. ?? 101, 102, 103 and 112 of the US Patents Act, which may be summarized as follows:

Mobile Applications: Legal Issues

For even small and start-up technology companies, one of the largest and quickest revenue generators is the MOBILE APPLICATION DEVELOPMENT. However, the more important and serious issues for mobile application development companies are legal protection and agreement for their applications. The laws governing the mobile applications widely depend on nature of subject, nature of consumer and the business model used for developing the application, it is necessary to consider the following points:

Intellectual Property Right (IPRs) in Application Software

A copyright is given to the intellectual property right in the application software which is enjoyed by the authors from the moment the code is written by them. If the application development code is outsourced to a vendor, which is either achieved through a joint venture or taken from open source software, in any case the ownership to the copyright may be complicated.? When a part or complete application development has been outsourced, the vendor agreement should safeguard the financing party that all the IPRs have been acquired through a properly legal drafted ?work for hire? clause. Moreover, while the application is being developed it is very important that the vendor should be bound with a non disclosure agreement so that confidentiality is ensured.

Open Source Software

Open source software is used in 88% of Android phones and 41% of the IOS phones. OSS licenses have special requirement for attribution, distribution and non-discrimination with respect to the platform. Further, a single application may use a combination of OSSs, each governed by a different license.

Intellectually Property Right in Content

Copyright content such as images, videos and sound recordings might be used in the development of the application. ?Right Clearance? is required by the developers from the copyright owners in order to be protected against infringement claims. It is important to receive permission for use where such rights have not been licensed.

If the application or its features are similar to a prior registered or recognized trademark, Trademark issues might also arise. The actual test of the infringement is recognizing the use of another?s trademark which is not confusing the user regarding the origin of the application. This could lead to the infringement in a number of different ways which include:

  1. Name of the application.
  2. Layout of the application.
  3. Existing trademark used in the marketing of the application.

In order to avoid the infringement issues, the developer should identify the use of prior trademarks and inform the user that the application is not endorsed by the trademark owner. If the requirements of the safe harbor clause are followed by the developer, Digital Millennium Copyright Act might help avoiding the liability. The requirements include:

  1. When a complaint is received remove the infringing material.
  2. Disable the repeat infringers from using the application.
  3. No direct financial benefit from the infringing activity.
  4. Adopt technical measures to avoid infringement.

Privacy and Data Collection Issues

Recent studies show that privacy and data storage have become real concerns for the users. Failure to address the end user?s privacy may result in a negative way to the application?s consumer support and sale.

Privacy and data protection can be addressed by making effective terms of use and privacy policy statements that are reflective of the developer?s consumer base practices. The privacy statements must include:

  1. Information collected
  2. Way of storing
  3. Usage by the developer
  4. Privacy on the information
  5. Providing information
  6. Contact information for user complaints

Specific laws govern the use of information if the target is towards the application that collects financial, personal or health data.

Jurisdiction

The application developer needs to consult the laws in the country where the application would be distributed. Laws like consumer protection, privacy and data protection are different in U.S. as compared to Europe, China and India. If the App is being distributed in country apart from U.S., it is highly advisable to consult with?an attorney or other expert in mobile and consumer laws?of those countries.

See sound waves levitate drops of liquid

Scientists have figured out how to use sound waves to levitate droplets of liquid. While the phenomenon is gee-whiz cool in its own right, the technique could lead to the development of new drugs that the body efficiently absorbs.

The contraption consists of two small speakers that generate sound waves at frequencies slightly above the audible range, roughly 22 kilohertz. The speakers are aligned one above the other so that their sound waves interfere with each other and create what?s called a standing wave.

At points along the standing wave known as nodes, the acoustic pressure from the sound waves is sufficient to cancel out the effect of gravity, enabling light objects such as droplets of liquid to levitate when placed there, according to a press release from?Argonne National Laboratory.

As seen in the video below, there are several nodes between the speakers, allowing Argonne?researchers to levitate several droplets at once.

The phenomenon was originally pioneered at NASA to simulate microgravity conditions. Chris Benmore, an Argonne X-ray physicist, and colleagues turned to the technique to figure out how to get the chemical compounds of drugs into a state that is more readily absorbed by the body.

At the molecular level, the lab explained, pharmaceutical structures fall into two categories: amorphous or crystalline. Amorphous drugs are more highly soluble and have a higher bioavailability, meaning they can be given at lower doses to get the desired effect.

The problem is getting a pharmaceutical from a solution into an amorphous state is difficult. If a solution evaporates while it is in contact with a container, it is far more likely to solidify in its crystal form.

One way to ?amorphize? the drug, the researchers reckoned, was to evaporate a solution without it touching anything. The acoustic levitator was the solution.

What?s more, the samples can be studied with the lab?s high-energy X-ray beam while it is being processed, allowing the researchers to understand the conditions that make for the best amorphous preparation.

The lab is currently pursuing a patent for their technique and partnering with academic researchers to determine which drugs their technique will impact most strongly.

New York City's new sugary drink rules, exceptions

The New York City Board of Health passed a rule Thursday banning sales of large sodas and other sugary drinks in restaurants, delis and movie theaters in the hopes of combating obesity. Here are the rules and the exceptions. They take effect in March.

? WHAT'S BANNED: Sweetened drinks in containers larger than 16 ounces. A range of popular sweetened beverages, including energy drinks, presweetened ice teas and common brands of nondiet soda will be affected.

? EXCEPTIONS: Beverages that are less than 25 calories per 8 ounces, more than 50 percent milk or 100 percent fruit or vegetable juice. Starbucks is pondering whether large Frappuccinos might fall under that exemption, except that it is made with a large amount of blended ice, which probably knocks the milk content down under 50 percent.

? CUP SIZE: Cafeterias and fast-food restaurants with self-serve soda fountains will be prohibited from giving out cups larger than 16 ounces, but people will still be allowed to refill their cup multiple times. Sit-down restaurants will no longer be allowed to serve pitchers of soda to customers.

? WHO'S AFFECTED: Only establishments that receive inspection grades from the health department would have to obey the rules, a group that includes movie theaters and stadium concession stands. Convenience stores, including 7-Eleven and its king-size "Big Gulp" drinks, would be exempt, along with vending machines and some newsstands. Beverages sold in supermarkets or most convenience stores are not affected.

? IN QUESTION: Iced coffee may be problematic. Many cafes now sweeten the beverage with liquefied sugar before handing it over to the customer, often in a giant cup, largely filled with ice cubes. Under the new rules, customers might have to add the sweetener themselves to avoid a violation.

? ENFORCEMENT: Will be carried out by New York City's army of restaurant inspectors. Violations uncovered during those inspections will lead to a $200 fine.

(AP) ? Beef Products Inc. will face a steep climb in its "pink slime" defamation lawsuit against ABC News as the South Dakota-based meat processor works to rebuild its public image, legal experts say.

BPI sued ABC News, Inc. for defamation Thursday over its coverage of a meat product that critics dub "pink slime," claiming the network damaged the company by misleading consumers into believing it is unhealthy and unsafe.

The Dakota Dunes, S.D.-based meat processor must prove that the network knowingly published false information and intended to harm its business. A lawyer for BPI expressed confidence that the company would prevail. But defamation- and food-law experts said the case would be difficult to win.

The lawsuit seeks damages under South Dakota's defamation law, as well as a 1994 state law that allows businesses to sue anyone if they knowingly spread false information that a food product is unsafe. The company is seeking $1.2 billion in damages for roughly 200 "false and misleading and defamatory" statements about the product ? officially known as lean, finely textured beef ? said Dan Webb, BPI's Chicago-based attorney.

The 257-page lawsuit names American Broadcasting Companies Inc., ABC News Inc., ABC news anchor Diane Sawyer and ABC correspondents Jim Avila and David Kerley as defendants. It also names Gerald Zirnstein, the USDA microbiologist who named the product "pink slime"; Carl Custer, a former federal food scientist; and Kit Foshee, a former BPI quality assurance manager who was interviewed by ABC.

ABC News, owned by The Walt Disney Co., denied BPI's claims.

"The lawsuit is without merit," Jeffrey W. Schneider, the news station's senior vice president, said in a brief statement Thursday. "We will contest it vigorously."

Webb expressed confidence Thursday that the company would win. The lawsuit filed in a Union County Court in South Dakota cites network reports that said the product was made with "low grade" meat, including "scraps" and "waste." ABC News also allegedly said the beef was made from connective animal tissue, when, in fact, it's made from muscle, according to the lawsuit.

Company officials have long insisted that the product is safe and healthy, and blamed the closure of three plants and roughly 700 layoffs on what they viewed as a smear campaign.

The lean, textured beef trimmings were the subject of many media reports earlier this year, and also have drawn comments from television chefs and food commentators. This year's social media uproar prompted Beef Products to suspend operations at plants in Amarillo, Texas; Garden City, Kan.; and Waterloo, Iowa. Beef Products' plants in Iowa and Kansas each produced about 350,000 pounds of lean, finely textured beef per day, while the one in Texas produced about 200,000 pounds a day.

Nick Roth, director of engineering for BPI, said the company is "absolutely dedicated to rebuilding," but he conceded that it's going to be hard to get back to where they were before the controversy. Company officials said there are no plans to file for bankruptcy at this time.

"The U.S. places great importance on free speech and the value of open public debate," Hamilton said. "A jury may have a very difficult time finding the news stories involved here were defamatory, or that there was any intent to harm the company."

South Dakota is one of 13 states that have enacted a food-disparagement law, but there's virtually no history of the laws being used in lawsuits, said Neil Hamilton, a Drake University professor and director of the Agricultural Law Center in Des Moines, Iowa.

Food-disparagement laws are also in place in Alabama, Arizona, Colorado, Florida, Georgia, Idaho, Louisiana, Mississippi, North Dakota, Ohio, Oklahoma and Texas. Hamilton said the most recent state to approve a law was North Dakota in 1998, and the issue has since received little attention.

One of the most high-profile cases involved Oprah Winfrey, who was sued in 1998 by a group of Texas ranchers for a show in which she swore off eating hamburgers because of mad cow disease. Greg Sattizahn, chief legal counsel for South Dakota's judicial system, said no appeal dealing with the food disparagement law has come before the state Supreme Court. The judicial system does not track civil cases filed in circuit court by the section of law cited, but he does not remember hearing of any lawsuit based on the disparagement law being filed in circuit court anywhere in South Dakota.

BPI will have to produce "extreme" evidence that the network acted irresponsibly, such as proof that their research used obviously unreliable sources, said University of Wisconsin journalism professor Bob Drechsel, who teaches media law.

Drechsel said he wasn't surprised to see the lawsuit but questioned whether it would succeed. Most defamation cases end with a settlement or a judge's order dismissing the case before it goes to trial, he said.

"It's always an uphill battle for anyone to win a libel suit," Drechsel said. "They're going to have to prove that ABC falsely reported information, and they're going to have to prove that ABC News knew that the stories were false or they had serious doubts about the truth."

Drechsel said the lawsuit may also be a tool to generate publicity and restore the company's image.

"Sometimes, you don't always sue to win," he said. "You win when you sue."
